Certain cases cannot be resolved through a negotiated resolution/plea agreement or certain clients simply desire to exercise their constitutional right to a jury trial. Lawyers are not created equal and most lawyers are not trial lawyers. When consulting with a criminal defense attorney, always question them about their trial experience, the number of jury trials they have completed, the types of charges involved in those trials, and the results they have obtained at trial. Any criminal defense attorney worth hiring to represent you should have extensive trial experience, even if you do not want to have your case proceed to trial because your attorney's trial experience is a factor that Prosecutors will consider in deciding what type of plea deal to offer you. If your lawyer has extensive trial experience, the Prosecutor will be more inclined to extend a favorable offer to resolve your case because they understand that your lawyer is capable and willing to push your case to trial and prepared to win if the Prosecutor’s offer is unreasonable.

Mr. Villegas has obtained Not Guilty verdicts in cases involving grand theft, resisting arrest, indecent exposure, lewd conduct, battery, evading arrest, DUI, battery against police officer, assault on police officer, domestic battery/violence, battery resulting in great bodily injury, check fraud, bank fraud, violating a protective order/restraining order, criminal threats, prostitution, vandalism, drug possession, under the influence of narcotics, robbery with knife, residential robbery with a handgun, assault with a deadly weapon, brandishing a weapon to resist arrest, and 3rd Strike life in prison cases to name a few. In July 2015, in People v. L.C. (BA432983), Mr. Villegas’ client faced a life sentence on a 3rd strike case where the client was charged with felony strikes for 1st degree residential robbery (P.C. 211), 2nd degree robbery (P.C. 211), and assault with a deadly weapon (P.C. 245(a)(1). He was also charged with special allegations/enhancements for inflicting great bodily injury on the victim, use of a knife and gun during the commission of the robbery, and an allegation of elder abuse because the alleged victim was 76 years old. After a two-week jury trial, the jury agreed with Mr. Villegas and returned Not Guilty verdicts on all counts and my client avoided a life in prison sentence, was released from custody and returned home to his family.

Most cases are resolved short of a jury trial, but it is always best to have an attorney representing you that is a proven and successful trial lawyer.
